These Terms of Service ("Terms") govern the Sopetified mobile app, the sopetified.in booking website, and the sopetified.myshopify.com store (together, the "Services").

By using any Service you agree to these Terms.

1. Eligibility

You must be at least 13 years old. If under the age of majority (18 in India, 16 in most of the EU), you must have parental consent. You must not have been previously suspended by us.

2. Your account

One account per person; keep your password private; no impersonation or transfers. Notify us at ask@sopetified.in if you suspect unauthorised access.

3. What we offer

1.             Consultations & sessions — telepathic pet communication, land / nature communication, Bach Flower therapy, courses, and workshops with Soha Kulkarni. Bookings inside the app or on sopetified.in are requests; Soha personally confirms over WhatsApp and settles payment offline.

2.             Community feed (app only) — a moderated space to share your pet's journey. Free account required to post.

3.             Store (Shopify) — handcrafted holistic pet-wellness products sold through sopetified.myshopify.com. Sopetified is the seller of record.

4. Session confidentiality 🔒

•               Every session with Soha is 100% private.

•               The result is shared with you and only you, via a private PDF report delivered to your Sopetified account.

•               We do not publish, quote, transcribe, screenshot, tag, sell, share, index, or feed session content to any third party, social channel, marketing material, or AI model.

•               No employee, contractor, or vendor other than Soha Kulkarni has access to your session content or your PDF report, save for the automated storage systems required to deliver it to you.

•               We will resist any demand for session content unless compelled by a court of competent jurisdiction in Mumbai; in that case we will notify you first to the extent legally permitted.

This is a binding commitment, not marketing copy. Any breach entitles you to the remedies in §11–§13 within the caps stated there.

Nothing in a session is medical advice. For acute medical issues please contact a veterinarian.

5. Bookings, cancellations & refunds - sessions and courses

•               All consultations, courses, and workshops are strictly non-refundable. Payment reserves Soha's time and preparation for you specifically.

•               If you cannot attend a confirmed session, write to ask@sopetified.in at least 24 hours in advance and we will do our best to offer a one-time reschedule at Soha's discretion. Reschedules are a courtesy, not a right.

•               No-shows are treated as complete sessions; the fee is forfeited.

•               Session reports once uploaded cannot be withdrawn or refunded.

6. Shopify store - orders, shipping & product refunds

The Sopetified store operates on Shopify's platform. By placing an order you also agree to Shopify's own Terms of Service.

6.1 Pricing & taxes — prices are in ₹ inclusive of GST where applicable. Prices, offers and stock can change any time before checkout completes.

6.2 Order acceptance — an order is a request to buy. We may refuse or cancel any order due to unavailability, suspected fraud, pricing error, or shipping restrictions, and will refund any amount already charged in that specific case.

6.3 Shipping

•               India-only shipping through partner couriers.

•               Dispatch: 3–7 business days from order confirmation.

•               Delivery: 3–10 business days from dispatch, depending on courier and pincode.

•               Shipping fees, if any, are shown at checkout.

•               Risk of loss transfers to you once the courier successfully delivers to your address.

6.4 Refunds, returns and exchanges — all product sales are final

Every Sopetified product is handcrafted in small batches. Orders once shipped cannot be refunded, returned, or exchanged. The only exceptions are:

•               Damaged in transit — email photos to ask@sopetified.in within 48 hours of delivery → replacement (subject to stock) or store credit at our discretion.

•               Wrong item shipped — email within 48 hours → replacement.

•               Non-delivery — courier-confirmed loss → replacement or store credit.

Store credit is valid for 12 months and is non-transferable.

6.5 Cancellations — an order may be cancelled by writing to ask@sopetified.in only if it has not yet been dispatched.

 7. Birthday gift

One free gift per pet per calendar year, India-only, subject to the freebie catalogue and stock. Sopetified may substitute a gift of equivalent value, or cancel the offer for a specific pet on detecting fraud, abuse, or address stuffing.

8. Community rules

You will not post content that is hateful, harassing, sexually explicit, violent, medical advice presented as if from a professional, spam, competing advertising, copyrighted material without permission, an impersonation, or an attempt to bypass moderation.

We may hide, remove, suspend, or terminate. Use the in-app Report button to flag posts.

9. Your content

You keep ownership of the photos, videos and text you post. You grant Sopetified a non-exclusive, worldwide, royalty-free licence to use it solely to run and promote the Services. This licence ends when you delete the content or your account, except for copies already shared onward or that we must keep by law.

Session PDFs are excluded from this licence — they belong to you; §4 governs.

10. Intellectual property

"SoPetified", the logo, our design, written content, product photography, and product recipes are owned by Sopetified. No copying, modifying, or reselling without written permission.

11. Disclaimers

Services are provided "as is" and "as available". We do not guarantee uninterrupted or error-free operation.

Sopetified is not a veterinary service. Nothing here is medical or veterinary advice. For a sick or injured pet, please contact a qualified veterinarian.

Session reports are Soha's professional opinion and are not a substitute for veterinary diagnosis.

To the maximum extent permitted by law we disclaim all warranties, express or implied.

12. Liability caps

Sopetified's total aggregate liability is capped as follows. These caps are cumulative maxima across all claims combined for the 12-month period preceding the first event giving rise to a claim:

12.1 Consultations, courses & workshops — total liability is capped at the fee actually paid by you for the specific session, course, or workshop that is the subject of the claim. Since sessions are non-refundable (§5), this cap is your sole and exclusive remedy for dissatisfaction with a session outcome.

12.2 Physical products (Shopify store) — total liability is capped at the purchase price of the specific product (excluding shipping). The only remedies are the damage / wrong-item / non-delivery remedies in §6.4.

12.3 Free / non-paid Services — for the community feed, free birthday gift, or guest browsing, total liability is capped at INR 1,000.

12.4 Ecosystem-wide cap — regardless of the cause of action or the number of claims, Sopetified's total aggregate liability in any 12-month period is capped at the greater of (a) INR 25,000, or (b) the total amount you paid Sopetified in the 12 months preceding the first event giving rise to the claim.

12.5 Categories we exclude entirely — Sopetified is not liable for indirect, incidental, special, consequential, exemplary or punitive damages; loss of profits, goodwill, or business; loss of pet behaviour or wellbeing outcomes; or loss of data.

These limits do not apply where the law prohibits them (death, personal injury, fraud, gross negligence).

13. Indemnity

You agree to defend and hold Sopetified harmless from any third-party claim arising out of (a) content you posted, (b) your breach of these Terms, or (c) your misuse of the Services. Does not apply where the claim was caused by our own wrongdoing.

14. Account deletion, suspension & termination

•               Delete your account any time from Profile → Delete my account — permanent, cascades your pets, posts, comments, likes, follows, bookings, gift claims, notifications, and session PDFs, subject to the retention windows in the Privacy Policy §6.

•               Shopify orders are governed by Shopify's own deletion process; write to us with the order number and we will pass the request on.

•               We may suspend or terminate for breach, legal reasons, or protection of others.

•               Sections that survive: 4 (Confidentiality), 5 (Non-refund), 6.4 (Store refunds), 9 (Content licence — for onward-shared content), 10 (IP), 11 (Disclaimers), 12 (Liability), 13 (Indemnity), 15 (Governing law).

15. Governing law & disputes

•               Laws of India govern.

•               Courts of Mumbai, Maharashtra have exclusive jurisdiction, subject to any mandatory consumer-protection rights you have in your country of residence.

•               Please write to ask@sopetified.in before starting a court claim; we will try to resolve within 30 days.

16. Miscellaneous

Severability applies. No waiver by non-enforcement. We may assign to a successor; you may not assign your account. These Terms + the Privacy Policy form the entire agreement. Shopify is an intended third-party beneficiary of §6.
